All works displayed on this site are original paintings created by Brandon Aday. Acquiring a work transfers physical ownership of that work to you. It does not transfer copyright, reproduction rights, or any right to license images of the work.
The artist retains all intellectual property rights, including the right to reproduce the work in books, exhibition catalogs, press, and editorial materials. You may photograph an acquired work for personal documentation, sharing it casually on social media, and home use. Commercial reproduction, printmaking, merchandise, or NFT minting requires written permission.
Prices are listed in U.S. dollars and exclude shipping, framing, and applicable state or local taxes unless explicitly stated.
An acquisition is complete once payment has cleared and the studio has issued a confirmation. Each acquired work ships with a Certificate of Physical Origin documenting medium, dimensions, and chain of custody.
A leased work is rented from the studio for a stated monthly fee over a defined term. The studio retains ownership of the work for the duration of the lease; the lessee holds a possessory interest only.
Monthly fees are due on the first of each month. At any point during the lease, the lessee may convert the lease into an acquisition at the buyout price quoted in the agreement; the remaining lease balance is waived upon buyout. The lessee is responsible for the safekeeping and reasonable care of the work during the lease term, including damage caused by mishandling, fire, flood, or environmental exposure.
Bespoke commissions are quoted individually after a written brief. A fifty percent deposit is required to begin work; the balance is due before delivery. The studio commits to a target completion window in the brief; minor variation is normal for hand-made work.
Commissioned work is not returnable except where the work arrives with a manufacturing defect not present in the agreed brief.
Works are professionally crated and shipped, insured by the studio in transit. Domestic shipping in the United States is included on acquisitions over $5,000. International shipping is quoted separately and may incur customs duties payable by the recipient.
Risk of loss transfers to the buyer at the moment of delivery at the agreed shipping address.
Each work is one of a kind. The studio accepts returns of an acquired work within fourteen days of delivery for a full refund of the purchase price, less return shipping costs and any measurable depreciation if the work has been altered.
The work must arrive at the studio in its original condition. Commissioned works are non-returnable except in the case of defect described above.
Information you submit through the inquiry form is recorded by the studio and used to respond to your request, follow up on a quote, or schedule a visit. The studio reads every inquiry; we do not share or sell inquiry information. See the Privacy Policy for details.
The studio’s total aggregate liability for any claim arising out of an acquisition, lease, commission, or use of this site shall not exceed the amount paid by you to the studio in the twelve months preceding the claim.
The studio is not liable for indirect, incidental, or consequential damages, including loss of profits or business opportunity.
These terms are governed by the laws of the State of Florida, without reference to its conflict-of-laws principles. Any dispute arising under or related to these terms shall be resolved in the state or federal courts of Miami-Dade County, Florida.
The studio may update these terms at any time. The current version is always posted at /terms. Material changes will be noted with a revised “last updated” date above.
